Employee Classification Cases
As an employee, you expect to be classified in a way that ensures you receive the appropriate benefit enrollment opportunities. Your company will have the responsibility of maintaining the correct employee classification so there is no discrimination in terms of wages, compensation, overtime pay, or other benefits. Unfortunately, mistakes are made and can lead to significant oversights.
We are currently representing a large number of field engineers who were involved in manually installing equipment on cell phone towers across the U.S. These engineers were misclassified as exempt under the Fair Labor Standards Act (FLSA). As a result, the workers were not paid appropriate overtime wages. There are currently more than 20 pending arbitrations and we are now acting as lead counsel on behalf of these parties. Cases are pending in California, Texas, Virginia, and Illinois. If you think you may qualify, contact us at (713) 236-8330 to learn about your options.
